Delivery conditions and sales terms
1. Conditions of sales
Unless otherwise agreed all sales made by Luchs International GmbH on these conditions of delivery and sale. No variation of these conditions of delivery and sale or any terms supplied with any order form or other document provided by you will be binding on Luchs International GmbH unless confirmed in writing by the Export Manager or General Manager of Luchs International GmbH. All goods are subject to availability. As a result of continuing development the specification or design of goods may vary from that shown in our catalogue or website.
You are responsible for deciding on the suitability of the goods offered for any particular purpose and for the consequences arising from any work we undertake on the goods at your request.
2. Prices and payment
All prices in our catalogue, leaflets and website are in EURO and without sales tax and were correct when published and given in good faith. Luchs International GmbH reserves the right to change the advertised price before you place an order. Unless otherwise agreed payment is required prior to delivery of the goods. For so long as any amount to be paid for goods remains owing to Luchs International GmbH title to goods will remain with Luchs International GmbH and will not pass to you until Luchs International GmbH has received payment in full including any interest due.
3. Delivery
Goods held in our warehouse are usually dispatched the same or next working day and delivered within 2-3 working days in Germany – although bulky or fragile items may take longer as well as delivery overseas and outside of Germany. Risk of loss or damage to the goods shall pass to you upon delivery. Claims for damage to goods must be noted at the time of delivery and notified to Luchs International GmbH in writing within 3 days of delivery to you. Claims for non-delivery of goods must be notified to Luchs International GmbH in writing within 7 days of the invoice date. Goods returned will be accepted entirely at Luchs International GmbH’s discretion within 30 days of delivery to you provided that they are returned unused, in perfect condition and in their original packaging. Free carriage paid returns applies to Germany only and Luchs International GmbH stocked catalogue product lines. You must contact us for authorisation to return goods on our Customer Service Line +49-(0)180-5448050. Any goods returned to Luchs International GmbH without authorisation or which are not in the condition set out above will be rejected and returned to you at your cost. Luchs International GmbH reserves the right to charge an administration charge on all returns. Where goods do not appear in a Luchs International GmbH publication (including but not limited to our catalogue or a leaflet or our website) and are specially ordered, embroidered or customized for you Luchs International GmbH will only accept the return of the goods if they are defective and returned within 30 days of delivery to you. Luchs International GmbH reserves the right to charge a re-stocking charge of up to 30% of the goods value.
4. Guarantee and liability
Luchs International accepts no liability of whatever nature arising as a result of any representations breach of contract, late delivery of product, negligence or otherwise including but not limited to liability for indirect or consequential loss, or loss of profits, revenue, business or goodwill except for liability for death or personal injury caused by Luchs International GmbH negligence. All conditions warranties guarantees and representations, express or implied, by statute, common law or otherwise in relation to the goods (other than any liability which Luchs International GmbH is not permitted by law to exclude or restrict) are hereby excluded.
5. Status
Luchs International GmbH may at its absolute discretion decline to accept orders or to offer credit terms. All errors and omissions excepted. All trademarks acknowledged.
